Doesn’t matter if all involved were underage. In the eyes of the law they were in possession and distributing child pornography. That’s just a fact.

Then why didn’t the feds prosecute? Why did they hand it over to the DA? Where in that document do you see “child porn”? What’s a fact?

Your right. The young lady is full of #### and looking to get paid. Now to more important things. Can y’all get that 7th ring. I’d pull my daughters out tomorrow if I were down there. Disgusting.

Didn’t say that. Didn’t even get close to saying that. I hope they get whatever justice they are seeking to bring closure to the situation. I’m just trying to bring a tiny bit of common sense in the discussion. I think before we have all the facts accusing people of child porn is a little bit overboard.

I think some might be thinking that him being a football player they may be looking the other way. From what I read the law said it was a he said she said situation but if there is a video out there someone did something and is in a lot of trouble. Cell Phones are nice to have but they can get you in a lot of trouble also...Possibly ruin your life.

That makes sense. Im glad I grew up before smartphones, the internet and social media.

I've fixed the tag. I hope that helps clear things up.

They must have put it back up, because I just fixed it less than five minutes ago. And I think this thread needs to be shut down if it gets out of hand.

I’m not condoning what the athlete did by any means at all!!! It’s a said situation and I feel for the girl and boy involved along with their parents and families. Do I feel their should be punishment, without a doubt! Most all of us on here have kids, boys and girls, I have put myself as a parent in the position of both of the parents that are involved with this situation. What if that was my daughter or son, what if that was your daughter or son? Kids are going to make mistakes and we have all made mistakes ourselves and we all have to live with them the rest of our lives. Should we judge a kid by one mistake, no, and the Good Lord above says that.

Unfortunately in today’s society with technology, cell phones, social media and all these different apps,,, kids take for granted what the intended purpose of a cell phone should be used for. I have had discusssions with my kids what a cell phone is really intended for and if they miss use that intended use of a cell phone in the wrong way, there are consequences. I encourage parents to do the same. If you think that what happened doesn’t happen with kids in your school, in your town or community,,, you better think again!!! Unfortunately, some kids in today’s society feel they need to do stuff like this for whatever the reason may be, weather unwillingly or willingly.

After reading the lawsuit, which is 1 side of the story from the girl and her parent! There are always 2 sides to a story, Side 2 : the athlete, CISD, the superintendent, the principal, the head coach, the police department, the district attorneys office and the FBI Cyber Division. All those mentioned above did an investigation within the legal limits of their powers. Some had more legal power than others by law. Do I think that CISD and it’s administrators: Supt, Principal and Head Coach, etc. conspired to cover this up, hide information, didn’t do an investigation,,, no! Why would any of those risk their reputation on this matter? I think the school did what they could do under the limits of the law.

My problem with this lawsuit is this:

In relation to the video and the nature of the charge, why were their not any charges file by District Attorney? Why did the FBI Cyber Divison not file any charges, they do not have to go thru the DA for them to file charges, they can file their charges in Federal Court since this was Felony Cyber related charge? Evidently they didnt do their due justice for the girl according to the law. Why is the parent not directing some blame on these law enforcement agencies. That’s a scary problem!

Second, I don’t see how CISD can be held responsible for something that initially took place and happened at a house of another parent, not during school hours or on school property with the video initially being shared off campus and not during school hours. Yes, it was shared later on to kids at school and any of those that received it or shared it are just as responsible, but it initially was shared away from CISD property and school hours. If this goes to court and a judge or jury sides with girl and her parent,,, every school district in the state and country will have a lawsuit filed against them for something that happened, whatever the case may be, between kids in a school district off school property and not during school hours. Did the school investigate the matter when it was brought to their attention, yes. Was it handled the way the parent thought it should have been, evidently not, that’s why we have a lawsuit.

Third, if Civil Rights have been violated, if anything, its a Right of Privacy, because of the video and nature of it and the what the girls were doing. That should be filed against the boy, not the school district. Just wondering why the second girl has not filed any charges or a lawsuit?

Fourth, some of the the things listed in lawsuit are pretty far out: principal being a former bulldog football player, implementation of the counselors, teachers and administrators, coaches pay compared the Lake Travis head coach, school funding from the state. Etc..

I think there are not going to be any charges files per DA and FBI Cyber Division, or they would have already filed them by now, they have pretty much made that clear. I think the parent of the girl is mad because of that and I would be too if I was in her place. I think her Statue of Limitations was going to run out at the end of April since the crime took place in April 2016 and I guess placing blame on the school was her next best option. I think CISD did what they could in their investigation according to the law. How was CISD suppose to stop the spread of the video? They don’t own the kids cell phones, by law they really don’t have the legal authority to go thur their phones and search for content of that nature, unless they have a warrant. How does a ISD get a warrant, they can’t. As a parent, would you want a school administrator going thur your child’s phone based on a accusation that you may or may not have explicit photos or videos on it? You run into the Right of Privacy again. I don’t, only if Im present with my child and with legal counsel for something of that nature and you or your counsel is going to ask if a report hasn’t been filed with police and if so your counsel is gonna say that the police are the only ones that can go thur the phone. I think the parent is trying to get whatever money she can since there is not gonna be any charges filled by the Policing Authority.

Since some on here want to jump on the Hate Carthage ISD Band Wagon because of this and the fact of who we are and that we have been so successful in football lately, I think you need to take a step back and wait and hear the other sides of the story from the athlete, CISD, Police, DA and FBI Cyber Divison if this gets to court. A lot has to take place for it to get to that point and it may be 1-2 years before that takes place. If it goes to court and they tell there side and the school and the names of people that are mentioned in lawsuit are cleared, some on here are going to be in for a big surprise when they find out that the ones that didn’t do their jobs that had the legal authority to do it. Let’s hear all the facts from both sides not just one side. On a side note, if my name was name in lawsuit and my name was cleared of any wrong doing, I’m counter suing the parent for defamation of my name. If we get to that point, there will probably be some more lawsuits

CISD is a great school district and they should not be judged by the actions of kids and what they do away from the school, off school property and not during school hours.

In cloisng I will state this again. I’m not condoning what the athlete did was right, it wasn’t, any sane person will agree with that. Is some punishment due, you bet. There are consequences for you actions. Should we judge the kid and hold it against him for the rest of their life, no. Should the actions of students away from an ISD school be a reflection on the school and should the school be held responsible, no. As parent if that was my daughter, I would be upset that the legal Policing Authorities didn’t file charges if they had the evidence. Sounds to me like they didnt give the girl due justice thur the legal system. Our legal system has statues set in place to prove you innocence, innocent until proven guilty, so let’s stop saying CISD is guilty of anything until we here their side and facts. Just remember before you wanna start judging or placing blame, you never know, this could be your daughter or son, your school district, your town or your community the next time it happens, and it will happen again, somewhere.

I’m a tax paying citizen of this town and school district. So yes, I know who is involved and their families, it’s a small town. I know some details that are not being said in the lawsuit and they will be brought up when the time comes if it goes to court. My prayers go out and have been going out for the girl, the athlete, the parents, the families involved, now the school district and the town of Carthage.

That is not true necessarily..... depends on consent but could only be seen in the eyes of the law as “Sexting” depending on the age differences.

New laws make schools the “cyber” police. For example David’s law. I think eventually laws will be overturned because schools should not have to deal with this unless it causes a disruption to the school day.....

I didn’t speak as an expert on this case, just saying that nude pictures amongst students isn’t always child pornography.

It’s just a way for some on here to incite more outrage to the situation by using the taboo term “child porn”. If it was child porn the feds would’ve been all over it and heads would’ve rolled a long time ago.

Sounds pretty bad. As the dad of two girls I hope justice (whatever that is) is served. Im no expert on civil law...so why is it relevant that the young man is a football player? Regardless, this is a bad, bad situation.

Maybe because it was a Carthage football player, just knowing that makes it more of a headline story.

Thank you.

Maybe because it was a Carthage football player, just knowing that makes it more of a headline story.

Not just football player, “the star quarterback”. Same reason the principle was referred to as a “former football star for Carthage High School”. Put Surratt salary in the document in relation to that of the AD at Lake Travis. It’s obvious this was the best way to get the headlines when it comes to Carthage. There has been a lot over the years about Carthage. Whether it’s the scoreboard, or Surratts salary, or whatever.

Don’t flatter yourself. I don’t give two ### about your Art Briles, your rings, your scoreboard. I only care about that young lady. Ego maniacs.

You must be a former tuba player with an axe to grind. Tuba on crazy!!

Good one. Can’t stand band and no where near Carthage. I do have 4 daughters which makes me a little passionate on the matter. Toot away.

I have daughters too and I can still see that the DA didn’t file, and the civil suit is written in such a way as to make guys like you flip.

have some emotional control and realize that something happened here, but the truth is not as sensational as you’d like it to be.

Read the whole thing before you comment please! They had their chance.

A lot of people need to read the whole suit. My gosh at this cliff notes version.

Then again so many probably don't understand the charges. IDK

I am not a lawyer so correct me if I am wrong. This is a Civil Rights Lawsuit, not criminal. This means they are suing for monetary restitution, not getting criminal charges. The way I read this, is the DA didn't see anything to prosecute on claiming He Said/She Said even after an FBI investigation. I am not taking sides either way, because I don't enough to do so. I was just making sure I was reading that right.

Punitive as well.

I'm just making a general statement here. I have no knowledge of the people supposively involved or any facts pertaining to this matter.

That being said, if the girl was underage and if a video was made of her nude (with or without her permission), anyone that is in possession of the video, whether on a phone, laptop or computer, or sends it to another person's said device, is in possession and distributing child pornography. That is a crime period.

I can't speak to how this has been handled because as many have said, not all the facts are out there if any. Like I said, I know nobody involved. Just stating the law pertaining to the video possession and distribution.
