Huge Win at Supreme Court on Climate Change

The Supreme Court limited the EPA’s ability to regulate carbon dioxide emissions from power plants in a 6-3 ruling handed down Tuesday that will have far reaching implications on the federal government’s overreach into disputed Climate issues.

 

The court held in West Virginia v. EPA that the Trump-era EPA did not violate the Clean Air Act by significantly softening planned limits on carbon emissions from power plants.

 

The court further agreed with a collection of Republican-led states and coal industry groups that the EPA, because its head is a political appointee, cannot accelerate the power sector’s transition from fossil fuels to clean energy because that goes beyond the powers granted to the EPA under the Clean Air Act.

 

“Capping carbon dioxide emissions at a level that will force a nationwide transition away from the use of coal to generate electricity may be a sensible ‘solution to the crisis of the day,’” Chief Justice John Roberts wrote, quoting from a previous court ruling. “But it is not plausible that Congress gave EPA the authority to adopt on its own such a regulatory scheme.”

The ruling was about an unelected part of the ADMINISTRATIVE branch making policy that went beyond the LEGISLATIVE branch authorization they were given..........your strawman was hilarious libnut.......

Amen.....and NOW any agency of the administration that tries to make laws or even rules that are not specified in the legislation wilI no longer be able to do it....

This ruling is not about Climate Change.  This rule is once again about government agencies overstepping their constitutional boundaries.  Even if it is for something we can all agree on, it still does not make overreach alright!

Pass laws instead of having agencies right rules that are beyond their authority!

I'm not saying i do agree with man made climate change being an issue, especially one that we can do something about with the stupid EPA regs.  I was meaning, even if they were doing something we could all agree on, if it is not legally in their power to do something, that is an overreach, whether it's a popular opinion or not.

Again, you are taking this as though the supreme court ruled that man-made climate change doesn't exist.  All they did was rule that the EPA has committed huge overreaches in their policy making.  They are doing things the legislative branch of the government is supposed to be doing.  This is not a ruling against climate change.  It's a ruling against government agencies performing roles they are not legally allowed to do and for good reason.  We already have too many unelected bureaucrats making de facto laws circumventing the legislative process.  It just so happens the case they ruled on has to do with the EPA, but it could involve any number of alphabet agencies.
