Homeowner arrested and forced to hand over her home keys to squatter…..

I mean, the way I understand the story, is the lady who owned the house had a family emergency. Left for several days (but less than a month), and came back to find out people had broken into her house and were living there. She calls the police, and she's the one who is removed.

That's messed up, man.

Texas has the SAME law. Well the 30 day thing may not be the case in Texas. Will need to check. I've been studying adverse possession a lot.

I agree. Totally messed up. People literally check obituaries to go occupy their home which is most likely the case in this story, but it's gets worse. Theirs a reason these laws haven't changed. 

Remember the Trump/Hilary debate when she accused him of taking advantage of the system? In response, Trump said, he definitely does take advantage of it but Hillary is not going to change the laws that allows this to happen b/c her friends benefit too. 

It's the same thing in this case.

You are correct and it's been on the books since the 1800's.  Texas even has squatters rights laws.  The problem is the law is intended for people to fix up these types of homes if they are abandoned.  That's usually when squatters take over.  As you pointed out above, they do check obits especially in larger cities for easier homes to target.  They hope that many families will forget about these properties in the grieving process.  It is a process to evict a squatter more so than renter, because there is already a lease that has been signed by the renter.  It can take years to legally evict someone that is squatting, and it actually may come at a cost depending on the $$$ of repairs that they have made to the home.  As proven by property taxes and squatters, no one truly owns a home in America.  Unfortunately this lady took matters into her own hands.  California's laws are even worse in squatters rights.  A good movie to watch on that is the Michael Keaton, Melanie Griffith, and Matthew Modine movie "Pacific Heights".  Keaton moves into an apartment that a young couple wants to rent out to help with their house payment, but never signs a lease giving him more rights than almost the owners themselves.

Actually they do :  Overview of the Squatting Laws in Texas | Bigham & Associates (bighamassociates.com) .  So if someone has property whether land or a house they need to check on it frequently or have someone do it for them.  If somehow the squatter  pays the property taxes for 5 years then the house is theirs.  If they make improvements to the property it could cost the landowner/homeowner even after they have legally evicted them.  

The lady in the New York case seems to have let the house go after her parents died, and then decided to check on the house.  Then she found the squatters there.  Had she or someone checking on the home they could have charged them with trespassing.  From the story, it sounds like she hadn't been doing that.
